What Types of 3/4 Disability Pension Cases Do We Handle?

We help NYPD and FDNY members access all kinds of accidental disability retirement pensions provided by New York laws, covering everything from line-of-duty injuries (9-/11 illnesses and other illnesses) related to police or firefighting service. Here’s how the different types break down:

  • World Trade Center Illnesses:Available to both NYPD and FDNY members who participated in rescue, recovery, or cleanup after 9/11. Statutes specifically cover respiratory illnesses and a wide range of cancers, with clear presumptions about job connection when documented within certain timeframes.

  • Heart/Stroke Bill:
Available to both NYPD (police) and FDNY (firefighter) members. If you passed your pre-hire physical and later developed heart disease or suffered a stroke, the law presumes your job caused it—General Municipal Law §207-k covers police (NYPD) and §207-a covers firefighters (FDNY).

  • Lung Bill:
Specifically for FDNY members. Firefighters who develop disabling lung or respiratory diseases after joining the job are covered under this bill, with the law presuming the illness came from duty-related exposure.

  • Cancer Bill:
Available mainly to FDNY members. This covers firefighters who develop certain types of cancer—including thyroid and endocrine cancers, and even Parkinson’s disease. These conditions are presumed to be work-related unless proven otherwise.

  • HIV, TB, Hepatitis:
Available to both NYPD and FDNY members. If you contract any of these after documented exposure during your duties, these conditions are considered duty-related and can qualify you for a 3/4 accidental disability pension.

  • Spousal/Line-of-Duty Death Benefits:
Available to both NYPD and FDNY families. If a member passes away from a duty-related injury or a covered presumptive condition, eligible survivors such as spouses and minor children may receive substantial benefits.

What Our Clients Say...

As a NYC Firefighter, I never thought for one moment that if I risked my life or my health, I would be roadblocked from receiving the equitable promise I signed up for when I took the oath of office. But in May of 2021, that’s exactly what happened. Upon going through the 1B and learning my fate with an ordinary decision, I visited three pension attorneys to figure out who to hire for what would be the most important decision of my life.

From the moment I met Tim and his staff, I knew I was in good hands. He didn’t promise me the world, but he told me he would do everything he possibly could to win my case. He gave me examples of similar cases he had handled before, answered all my questions, and clearly showed me what the road ahead would look like.

Throughout the entire process, I was kept well-informed by their gracious paralegals. They answered every question promptly and always told me what to expect next. At no point did I feel like I was wasting money on someone who couldn’t deliver. I actually know people they have turned away because they knew they couldn’t help them. The road through Article 78 court to win your pension isn’t an easy one, but when you have a skilled attorney who knows exactly what he’s doing, it makes the ride far less bumpy.

My case was won almost exactly two years from my retirement date. For me, that made the victory even sweeter on all accounts.

I owe Tim a debt of gratitude that no amount of money could ever repay. Anyone who thinks they received the wrong award for their service should immediately contact Tim. He changed my life — and he could possibly change yours.

- Michael Clancy (Ret. L152 FDNY)
